It is important to state that each state has the authority to regulate hemp products and hemp derived cannabinoids as they see fit. Some states have started to regulate the sale of these products, while some states have placed an outright ban on these products. For those in Virginia, we have bad news and we have good news. We’ll give the bad news first, but be sure to stick around for the good news! The bad news is that Virginia is one of the states that have placed over-restrictive regulations on hemp derived cannabinoids like Delta-8, Delta-9 and THCA derived from federally legal hemp.
The good news is that, in accordance with federal law, hemp-derived THCA flower and concentrates below the 0.3% Delta-9 THC limit can be shipped legally throughout the country. The Federal 2018 Farm Bill explicitly mentions that, while states do have the right to regulate hemp products within their borders, states CANNOT interfere with interstate commerce of hemp goods. This means that as long as a state (Virginia) has only banned the sale, and not the possession of these hemp cannabinoid products, and as long as someone orders from a state where it is legal to sell (North Carolina, for example), then the consumer is protected and Virginia cannot legally interfere with the shipment of these goods.
